Healthcare Professional Privacy Notice

Thai Otsuka Pharmaceutical Co., Ltd. (“TOP”) respects your right to privacy.

 

The data controller of your personal data is TOP.

 

In this Notice, when we talk about personal data, we mean any information relating to a natural person (“Person”), that can identify such Person, whether directly or indirectly, but not including the information of deceased Persons–. In this case, it is personal information related to you.

 

 

We collect, use, and disclose (collectively “process”) your personal data according to the Personal Data Protection Act B.E. 2562 (2019) (the “PDPA”). You should read this notice, so you know what personal data we collect about you, what we do with it and how you can exercise your rights in connection with it. You should also read any other privacy notices that we give you, that might apply to our use of your personal data in specific circumstances from time to time.

 

 

What personal data does TOP collect and why?

 

We may collect personal data about you from a variety of sources, including directly from you, documents or forms that you provide, publicly available sources, CVs and resumes, online or other databases, and websites.

 

TOP may process some or all of the following categories of personal data for the purpose(s) described below:

 

  • Personal details, such as your name, age, address, e-mail address, telephone number, birth date, national ID number, and passport number;
  • Professional details, such as your hospital name, education background, and doctor’s rank;
  • Information of the Healthcare Profession related to TOP’s product, such as monthly usage.

 

 

We process personal data for the purpose(s) of:

 

  • Contacting or reference in connection with the clinical trials
  • Internal use such as sale force program
  • Supporting healthcare professional engagement such as academic meetings
  • Managing the contractual relationship with you
  • Complying with legal obligations

 

 

Legal basis for processing personal data

 

The following is our legal basis for processing your personal data other than with your consent.

 

  • It is necessary for the performance of a contract
  • It is necessary for legitimate interests
  • It is necessary for compliance with a law

Who does TOP share your personal data with?

 

We disclose your personal data to the following categories of recipients:
to vendors which assist TOP in managing the employment and contractual relationship with you

 

  • to tour companies which help TOP support you for, and organize, an academic meeting trip
  • to an IT outsourcing service company which writes the sale force program
  • to governments and law enforcement authorities and
  • to Otsuka affiliates who need to see it to do their jobs.

 

 

International data transfers

Your personal data will be transferred to foreign countries/international organizations located therein (the “Foreign Organizations”) that have adequate data protection standards in accordance with the rules for the protection of personal data prescribed by the Personal Data Protection Committee” instead of the above

 

 

How long will your information be kept?

 

We retain personal data we collect from you for as long as we need it to fulfill the purposes for which it was collected (see above), or it is necessary where we have an ongoing legitimate business need to do so (for example, to provide you with a service you have requested or to comply with applicable legal, tax or accounting requirements).

 

 

Your rights

 

You have the right to request access to or obtain a copy of, receive, correct, erase, destroy or anonymize, or restrict of the use of, your personal data. You are also entitled to object to the processing of your personal data in certain instances. When we process your personal data based on your consent, you may withdraw it for the future at any time. Please note that where your personal data must be provided to us, the possible consequences of failing to do so need to be considered (see “Legal basis for processing personal data” above).

You also have the right to complain to a data protection authority about our collection and use of personal data. For more information, please contact the Office of the Personal Data Protection Committee, the supervisory authority of the data protection laws in Thailand.
